Fassineh Kamara, a 36-year-old civil engineer, appeared before Magistrate Mustapha Braima Jah at Pademba Road Court No.1 in Freetown to face a charge of murder.
The charge is instituted under Section 1 of the Offences Against the Persons Act 1861, as amended and replaced by Section 1(a) of the Schedule of the Abolition of Death Penalty Act 2021, Act No.6 of 2022.
Court documents state that on Friday, 24th October 2025, at #47 Jenner Wright Road, Up Gun, in the Western Area of Freetown, the defendant allegedly murdered Abdulai Kamara. Kamara did not enter a plea when the charge was formally presented and explained to him.
Assistant Superintendent of Police Ibrahim S. Mansaray led the prosecution. The first witness, DPC 14975 Musu A. Kamara, testified, confirming she recognized both the deceased (complainant) and the defendant.
The witness detailed that on the date in question, she and the scene-of-crime officer visited the location. She noted that the garage was secured with a gate and surrounded by barbwire. Her investigation revealed that the deceased was not a resident of the premises. She also expressed surprise that despite the circumstances of the death, a thorough check of the scene showed no evidence of damage.
The witness further stated that she reviewed the defendant’s voluntary caution statement. In the statement, the defendant alleged that he and the deceased had been involved in a tussle and claimed the deceased's injuries resulted from a fall from the rooftop. The statement also mentioned that recent thefts at the garage had necessitated heightened security measures.
According to the defendant's account, the deceased was on the roof with two other individuals who reportedly fled the scene when the incident occurred. The defendant concluded the statement by expressing his willingness to cooperate with the investigation.
During cross-examination, the witness was asked about discussions of self-defense, which she confirmed having heard. She affirmed that the defendant had told her he was acting in self-defense during the altercation with the deceased.
J.M. Jengo Esq. represented the defendant.
After reviewing the evidence, Magistrate Jah denied bail and ordered the defendant to be remanded at the male correctional facility in Freetown. The matter was adjourned to 16th December 2025 for continuation.
