Court Case Hits Snag as Defense Counsel Absent in $8,000 Theft and Vandalism Allegations

A crucial court battle involving two Fullah men, facing charges of property damage and the theft of $8,000, encountered a procedural delay on Monday due to the absence of the defense counsel.


Chernor Bah stands accused by his tribesman, Bashiru Jalloh, of malicious damage and larceny. 



Court records indicate Bah was arrested on October 22, 2024, and is charged with Malicious Damage, contrary to Section 51 of the Malicious Damage Act of 1861, and Larceny in a Dwelling House, contrary to Section 13(1) of the Larceny Act of 1916.


Prosecutors allege that on Saturday, April 6, 2024, at 9 Chapel Street, Krio Town Road, Freetown, Bah intentionally damaged a steel door and a wooden wine lock belonging to Jalloh.

 



Furthermore, it is claimed that on the same date and at the same location, Bah unlawfully entered Jalloh's residence with the intent to steal, making off with $8,000 USD in cash.


During Monday's proceedings, while Bah's defense lawyers were not present, they had previously submitted a written "No Case Submission."




However, after reviewing the case file, Magistrate Jalloh determined that sufficient grounds existed for Bah to answer the charges. She ruled that the matter would not proceed until the defense counsel was present in court.


Lead prosecutor CMB Amara, supported by DPC 18098 Sesay, concurred with the ruling and requested a brief adjournment. 


The case has been rescheduled for further hearing on August 18, 2025.
