Moriba Bail Refused After Evidence Handling Flaws Revealed

The cross-examination of the exhibit clerk in the incitement case against Mohamed Moriba, a prominent politician and former military officer charged with incitement contrary to law, revealed inconsistencies regarding the handling of electronic evidence.


During the proceedings before Magistrate John Manso Fornah at Pademba Road Court No. 2 in Freetown, Defense Counsel A.A. Bangura questioned DPC Mohamed Conteh, the exhibit clerk attached to the CID Headquarter’s Exhibit Office, regarding a critical pen drive containing electronic data relevant to the case.


The clerk confirmed that he received the device on January 22, 2026, from DPC Kamara A. However, when questioned about the pen drive's contents, the witness stated that he was unaware of what the device contained and could not recall recording or reviewing the data stored within it.


Upon the charge being read and explained, Moriba did not enter a plea, as the matter is a committal proceeding. The prosecution, led by Assistant Superintendent of Police Dillia Wellington, emphasized the critical nature of the evidence.


The defense renewed and adopted its previous application for bail on behalf of the defendant. However, Magistrate Fornah refused the application, citing the seriousness of the offense.


The court mandated that Moriba be remanded in the male correctional facility in Freetown. 


The case has been adjourned until May 20, 2026, for the continuation of proceedings.
