Magistrate Admonishes Journalists Over Sub Judice Reporting in Bo

Magistrate SJ Braima of Magistrate Court No. 2 in Bo has issued a stern warning to media practitioners, cautioning them against airing opinions on ongoing court matters. The directive was delivered on July 3, 2026, during the proceedings of a civil matter between Dr. Agyeman Koffie and Zainab Jalloh.
The court action involved four journalists—Solomon Joe and Samuel Haffer of Radio Bo Kiss 104.1 FM, and Anthony Gassimu Brima and Paul Kamara of Radio New Song 97.7 FM—who were subpoenaed following allegations that they broadcast information deemed sub judice, or currently under judicial consideration.
Counsel for the applicant, MM Sheriff of Kakua Chambers, alleged that Solomon Joe and Anthony Gassimu Brima published stories regarding the Koffie versus Jalloh case. The applicant’s legal team presented audio recordings purportedly aired on the "Doctor Owl" program on Radio Bo Kiss 104 FM and on Radio New Song 97.7 FM as evidence.
In response, the defense team—represented by KS Coomber, J. Harris, H. Baker, JH Kurabu, and M. Musa—argued that the cited recordings were never aired on the respective stations. Furthermore, they challenged the authenticity of the audio attributed to Solomon Joe, an allegation Joe denied vehemently.
After reviewing the evidence, Magistrate Braima dismissed the matter against Anthony Gassimu Brima. However, he ordered the management of Radio Bo Kiss 104.1 FM to produce recordings of the "Doctor Owl" program aired between June 14 and June 30, 2026, for further examination.
In his concluding remarks, Magistrate Braima clarified that his order should not be interpreted as an infringement on press freedom. He emphasized that while journalists are free to report on court proceedings, they must refrain from forming or disseminating opinions on matters that are still pending hearing and determination.
The case has been adjourned to July 14, 2026.
